TCPA & Communications Disclosure

Effective Date: Draft — pending review

Last Updated: June 4, 2026

DRAFT — for review only. This is a working draft prepared for a tax-practice platform. It is not legal advice and must be reviewed and approved by a licensed attorney before you rely on it.

TaxPulse provides optional communication tools — including SMS, email, and voice calling — so you can correspond with your clients (for example, appointment reminders, document requests, and status updates). This disclosure explains your responsibilities when using those tools. It supplements our Terms of Service.

1. You Are the Sender

When you use TaxPulse to call, text, or email, you are the party initiating the communication. You are solely responsible for the content of your communications and for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Telemarketing Sales Rule, and state and federal Do-Not-Call rules.

2. Consent

You are responsible for obtaining and maintaining any consent required before contacting an individual, particularly for automated or recurring calls and texts. You should only message clients and contacts who have a relationship with your practice or who have otherwise consented to be contacted, and you must honor opt-out requests promptly.

3. Appropriate Use

The communication tools are intended for legitimate communications with your clients and prospective clients about your tax services. They are not to be used for unsolicited bulk marketing to purchased or harvested lists, or for any unlawful, deceptive, or harassing communications.

4. Opt-Out and Help

Text messages should include clear opt-out instructions (for example, reply STOP to unsubscribe and HELP for help). You must process opt-out requests promptly and refrain from contacting individuals who have opted out.

5. Call Recording

If you enable call recording, you are responsible for complying with all applicable recording-consent laws. Many states require all-party consent. You agree to obtain any required consent before recording.

6. Carrier and Delivery

Message and call delivery depends on third-party carriers and providers and is not guaranteed. Carriers may filter, delay, or block messages. Standard message and data rates may apply to recipients.

7. Your Responsibility and Indemnification

TaxPulse provides communication tools but does not send communications on your behalf or control whom you contact. You agree to indemnify and hold TaxPulse harmless from any claims, penalties, or damages arising from your communications or your violation of any applicable communications law, consistent with the indemnification section of our Terms of Service.
